Classification system in the EU Common Military List
Military items are generally distinct from dual-use items. They are commodities (such as systems, equipment, components, materials, software or technology) that are in most parts specially designed or modified for military use. Examples of military items include fire control and thermal imaging equipment, weapons, ammunition, war vehicles, manned and unmanned war aircraft, vessels of war (surface or underwater), weapon sights, armored or protective equipment, some chemicals like nerve agents, explosives and propellants.
Remember that also software and technology (specific information) may qualify as military items. EU Common Military List category ML21 concerns software that is specifically designed or modified, as an example, for development, production, operation or maintenance of equipment specified by the EU Common Military List. EU Common Military List category ML22 concerns technology that is required, as an example, for the development, production, operation, installation, maintenance (checking), repair, overhaul or refurbishing of items specified in the EU Common Military List. Notions of software and technology in the EU Common Military List are similar to the notions of the same terms given in the EU dual-use Regulation.
The meaning of ‘specially designed for military use’ or ‘modified for military use’ is largely determined by the competent authority, which is the Ministry of Defence in Finland.
